{"id":10902,"date":"2017-12-08T00:00:00","date_gmt":"2017-12-08T00:00:00","guid":{"rendered":"https:\/\/francois-pelletant.fr\/blog\/?p=10902"},"modified":"2018-02-10T10:53:54","modified_gmt":"2018-02-10T10:53:54","slug":"appel-au-calme","status":"publish","type":"post","link":"https:\/\/francois-pelletant.fr\/blog\/appel-au-calme\/","title":{"rendered":"Appel &#8230;au calme"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\"><\/div>\n<p>&nbsp;<\/p>\n<p>Ce lundi, j&#8217;\u00e9tais au Tribunal d&#8217;appel de Paris pour le second proc\u00e8s dans l&#8217;affaire du bar associatif de Villejuif et des 6 st\u00e8res de bois qui ont transit\u00e9 entre la mairie de Linas et ce Bar.<\/p>\n<p>Beaucoup d&#8217;entre vous ont entendu parler de ce rendez-vous par des opposants qui ont annonc\u00e9 la mise \u00e0 mort du Maire de Linas au soir du 4 d\u00e9cembre 2017.\u00a0C&#8217;est me faire trop d&#8217;honneur que d&#8217;imaginer ma disparition pour compl\u00e9ter la s\u00e9rie de trois avec Jean d&#8217;Ormesson\u00a0et Johnny.<\/p>\n<p>L&#8217;adage &#8220;jamais deux sans trois&#8221; ne se v\u00e9rifiera pas gr\u00e2ce \u00e0 moi, d&#8217;une part parce que je suis bien vivant apr\u00e8s\u00a0sept heures d&#8217;audience et d&#8217;autre part parce que je ne suis pas dans la cat\u00e9gorie\u00a0de ces illustres personnages.<\/p>\n<p>Nous\u00a0serons fix\u00e9s sur le sort du Maire de Linas le 12 f\u00e9vrier.\u00a0Les Juges de Paris devront se prononcer sur l&#8217;affaire au regard du premier jugement sur lequel je fais appel (<a href=\"https:\/\/francois-pelletant.fr\/blog\/wp-content\/uploads\/2017\/12\/jugement-correctionnel.pdf\" rel=\"\">jugement correctionnel<\/a>) et de mes conclusions (<a href=\"https:\/\/francois-pelletant.fr\/blog\/wp-content\/uploads\/2017\/12\/Conclusions-PELLETANT-definitives-II.docx\" rel=\"\">Conclusions\u00a0<\/a>).<\/p>\n<p>En attendant bonne lecture.<\/p>\n<p><a href=\"https:\/\/francois-pelletant.fr\/blog\/wp-content\/uploads\/2017\/12\/Tribunal-Paris.jpg\" rel=\"attachment wp-att-10905\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-10905\" src=\"https:\/\/francois-pelletant.fr\/blog\/wp-content\/uploads\/2017\/12\/Tribunal-Paris-300x145.jpg\" alt=\"Tribunal Paris\" width=\"300\" height=\"145\" srcset=\"https:\/\/francois-pelletant.fr\/blog\/wp-content\/uploads\/2017\/12\/Tribunal-Paris-300x145.jpg 300w, https:\/\/francois-pelletant.fr\/blog\/wp-content\/uploads\/2017\/12\/Tribunal-Paris.jpg 322w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>Voici de quoi on m&#8217;accuse\u00a0:<\/p>\n<ul>\n<li><u>d\u2019ex\u00e9cution d\u2019un travail dissimul\u00e9 par dissimulation d\u2019activit\u00e9<\/u>, pour ne pas avoir d\u00e9clar\u00e9 l\u2019activit\u00e9 de l\u2019association ACEDA au Registre du commerce et des soci\u00e9t\u00e9s, ni celle de l\u2019association AHB au R\u00e9pertoire des m\u00e9tiers ,<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><u>d\u2019abus de confiance<\/u>, pour avoir d\u00e9tourn\u00e9 des fonds publics destin\u00e9s \u00e0 financer des emplois aid\u00e9s, et ce en finan\u00e7ant ainsi des employ\u00e9s dont le travail ne r\u00e9pondait pas aux conditions des emplois aid\u00e9s, dans le cadre des associations AHB et ACEDA,<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><u>de prise ill\u00e9gale d\u2019int\u00e9r\u00eat<\/u>, en sa qualit\u00e9 de Maire de la commune de Linas (91), pour avoir fait livrer des st\u00e8res de bois appartenant \u00e0 la commune de Linas \u00e0 destination de l\u2019association ACEDA,<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><u>d\u2019ex\u00e9cution d\u2019un travail dissimul\u00e9 par dissimulation d\u2019heures de travail sur les bulletins de paie<\/u>, pour avoir intentionnellement mentionn\u00e9 sur les bulletins de paie des employ\u00e9s des associations AHB et ACEDA un nombre d\u2019heures de travail inf\u00e9rieur \u00e0 celui r\u00e9ellement effectu\u00e9,<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><u>d\u2019escroquerie<\/u>, pour avoir fait \u00e9mettre des bulletins de salaire par l\u2019URSSAF pour un travail non effectu\u00e9 afin d\u2019obtenir indument de la part de la DRFIP et du Conseil R\u00e9gional de l\u2019Ile-de-France des subventions li\u00e9es aux contrats-avenirs, dans le cadre de l\u2019association ACEDA,<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><u>d\u2019abus de confiance<\/u>, pour avoir \u00e9mis des ch\u00e8ques au nom de l\u2019association AHB encaiss\u00e9s sur son compte personnel pour un montant total de 22.951,35 euros,<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><u>d\u2019embauche de salari\u00e9 sans d\u00e9claration pr\u00e9alable conforme \u00e0 l\u2019organisme de protection sociale<\/u> concernant Monsieur Romain LE HUU TONG, salari\u00e9 de l\u2019association AHB<\/li>\n<li><\/li>\n<li><u>d\u2019abus de confiance<\/u>, pour avoir d\u00e9tourn\u00e9 \u00e0 son profit la somme de 13.232 euros r\u00e9sultant de la diff\u00e9rence entre le chiffre d\u2019affaires issu des fiches de suivi de caisses et le total des encaissements effectivement r\u00e9alis\u00e9s, et ce au pr\u00e9judice de l\u2019association ACEDA.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp;
