L’annulation de la fermeture de la voie sur berge, attaqu\u00e9e par l’association des Maires Franciliens, devait \u00eatre jug\u00e9e au Tribunal Administratif ce jour 26 janvier 2018.<\/strong><\/p>\n

Malheureusement, et contre toute attente, l’audience a \u00e9t\u00e9 report\u00e9e au 7\u00a0f\u00e9vrier prochain<\/u> pour permettre la substitution de motif de la d\u00e9cision attaqu\u00e9e et lui donner une autre base l\u00e9gale que celle choisie par Anne Hidalgo en 2016<\/u>.<\/p>\n

En effet, la mairie de Paris avait motiv\u00e9 sa d\u00e9cision de fermeture de la voie sur berge par des consid\u00e9rations environnementales ; or il s’av\u00e8re que cet argument \u00e9tait mensonger et a \u00e9t\u00e9 d\u00e9menti depuis par de nombreuses \u00e9tudes que n’a pas manqu\u00e9 de faire valoir l’association des Maires Franciliens.<\/p>\n

Qu’\u00e0 cela ne tienne, le tribunal propose de ne plus se baser sur l’article\u00a0L. 2213-4 du CGCT qui donne au maire de Paris le pouvoir d’interdire \u00e0 la circulation certaines voies pour ne pas compromettre : “<\/em> la tranquillit\u00e9 publique, soit la qualit\u00e9 de l’air, soit la protection des esp\u00e8ces animales ou v\u00e9g\u00e9tales, soit la protection des espaces naturels, des paysages ou des sites ou leur mise en valeur \u00e0 des fins esth\u00e9tiques, \u00e9cologiques, agricoles, foresti\u00e8res ou touristiques<\/em>“,<\/em> mais sur l’article\u00a0L. 2213-2 qui est une interdiction de port\u00e9e g\u00e9n\u00e9rale.<\/p>\n

Ce “pas de deux” est tr\u00e8s r\u00e9v\u00e9lateur de l’ill\u00e9galit\u00e9 du coup de force qu’avait fait la mairie de Paris pour interdire au reste de la France le transit sur des voies de circulation nationales. En tout \u00e9tat de cause, l’arr\u00eat\u00e9 de la ville parisienne entr\u00e9 en vigueur \u00e0 l’automne 2016 est ill\u00e9gal et l’interdiction subie par bon nombre d’automobilistes depuis cette date \u00e9tait ill\u00e9gitime. Mais bien plus que cela, ce revirement d\u00e9savoue la mairie de Paris dans sa strat\u00e9gie du mensonge et du bluff pour imposer ses visions dogmatiques sur la mobilit\u00e9 au reste du pays<\/u>.<\/p>\n

La partie se joue serr\u00e9e, l’association des Maires Franciliens, et son avocat Damien Stalder, sont en train de fourbir leurs armes pour r\u00e9pondre \u00e0 ce coup de Jarnac judiciaire. En effet, l’association fait valoir que si, \u00e0 pr\u00e9sent, la mairie de Paris ne veut plus se baser sur l’article\u00a0L. 2213-4 du CGCT, elle ne peut interdire en permanence la voie et devra am\u00e9nager son interdiction avec des horaires et des conditions qui ont un caract\u00e8re exceptionnel.<\/u><\/p>\n
