Un \u00e9lu de la majorit\u00e9 municipale absent depuis cinq ans \u00e0 toutes les r\u00e9unions du conseil municipal.<\/strong><\/p>\n\n\n\n

Une adjointe au Maire a \u00e9t\u00e9 absente trois fois sur quatre<\/strong> aux r\u00e9unions du conseil, <\/p>\n\n\n\n

tandis qu’une autre adjointe est pr\u00e9sente une fois sur deux<\/strong>.<\/p>\n\n\n\n

Notre commune ne peut pas fonctionner avec des \u00e9lus fant\u00f4mes.<\/strong><\/h1>\n\n\n\n

\u00c0 la suite de la publication d’un article stup\u00e9fiant sur les chiffres de l’absent\u00e9isme au conseil municipal de Linas (page J’aime Linas https:\/\/jaimelinas.fr\/labsenteisme-au-conseil-municipal-de-linas\/), je rappelle les r\u00e8gles en la mati\u00e8re et je fais trois propositions :<\/p>\n\n\n\n

Les r\u00e8gles<\/h2>\n\n\n\n

Malheureusement, les absences r\u00e9p\u00e9t\u00e9es d’un \u00e9lu aux s\u00e9ances du conseil municipal ne peuvent pas entra\u00eener de sanctions. Le code des Collectivit\u00e9s territoriales indique pourtant que “Tout membre d’un conseil municipal qui, sans excuse valable, a refus\u00e9 de remplir une des fonctions qui lui sont d\u00e9volues par les lois, est d\u00e9clar\u00e9 d\u00e9missionnaire par le tribunal administratif.” <\/p>\n\n\n\n

Cependant, la jurisprudence du Conseil d’\u00c9tat consid\u00e8re que ces sanctions ne s’appliquent pas en cas d’absences r\u00e9p\u00e9t\u00e9es d’un \u00e9lu aux s\u00e9ances du conseil municipal (CE, n\u00b0 68842, 6 novembre 1985, maire de Viry-Ch\u00e2tillon).<\/p>\n\n\n\n

La seule possibilit\u00e9 de sanctionner les absences serait de le mentionner dans le r\u00e8glement int\u00e9rieur, mais ce n’est pas le cas \u00e0 Linas (L. 2123-24-2 du CGCT).<\/p>\n\n\n\n

Cette impunit\u00e9 est totalement incompr\u00e9hensible, alors que nos concitoyens, eux, sont p\u00e9nalis\u00e9s lorsqu’ils s’absentent de leur travail, et ce m\u00eame avec une raison valable.<\/p>\n\n\n\n

\u00c0 Linas, les \u00e9lus exploitent de fa\u00e7on excessive et inadmissible cette impunit\u00e9 de l’absent\u00e9isme. <\/p>\n\n\n\n

C’est plus un probl\u00e8me de morale que juridique.<\/p>\n\n\n\n

Proposition 1 : Restitution des indemnit\u00e9s vers\u00e9es ind\u00fbment<\/h2>\n\n\n\n

L’article L2123-24 du CGCT conditionne le versement des indemnit\u00e9s des \u00e9lus (700 \u20ac par mois pour un adjoint) \u00e0 “l’exercice effectif de leurs fonctions”. <\/p>\n\n\n\n

Les indemnit\u00e9s qu’ont re\u00e7ues les adjoints de la municipalit\u00e9 actuelle doivent donc correspondre \u00e0 un travail r\u00e9el. <\/p>\n\n\n\n

Si ce n’est pas le cas, ces indemnit\u00e9s n’auraient pas d\u00fb \u00eatre vers\u00e9es. <\/p>\n\n\n\n

Comme la majorit\u00e9 actuelle l’a fait pour moi en 2020, si je suis \u00e9lu en mars 2026, je ferai r\u00e9aliser un audit afin de r\u00e9clamer les indemnit\u00e9s vers\u00e9es \u00e0 tort \u00e0 ceux qui n’ont pas fourni un travail effectif ou qui ont \u00e9t\u00e9 absents \u00e0 des r\u00e9unions o\u00f9 ils auraient d\u00fb repr\u00e9senter la commune.<\/strong><\/p>\n\n\n\n

Proposition 2 : Un calendrier de r\u00e9union<\/h2>\n\n\n\n

Pour que le fonctionnement du conseil municipal de Linas soit stable, si je suis \u00e9lu en mars prochain, j’imposerai un calendrier obligatoire d’une r\u00e9union par mois du conseil municipal (sauf ao\u00fbt). Le planning annuel sera \u00e9tabli en d\u00e9but de chaque ann\u00e9e.<\/strong><\/p>\n\n\n\n

Le syst\u00e8me actuel de r\u00e9unions improvis\u00e9es et irr\u00e9guli\u00e8res sera abandonn\u00e9, et un fonctionnement clair sera remis en place. <\/p>\n\n\n\n

Ainsi, tous auront connaissance, bien \u00e0 l’avance, des jours de r\u00e9union et ne pourront pas pr\u00e9tendre avoir pris d’autres engagements.<\/p>\n\n\n\n

Proposition 3 : Liste en cours de constitution<\/h2>\n\n\n\n

Depuis quelques jours, des \u00e9chos me reviennent au sujet de la constitution des listes de candidats pour les \u00e9lections de mars 2026.<\/p>\n\n\n\n

Des linoises et des linoiss sont d\u00e9march\u00e9s de fa\u00e7on tr\u00e8s insistante par la municipalit\u00e9 sortante en mal de colistiers.<\/p>\n\n\n\n

D’autres se voient promettre des permis de construire ou des “facilit\u00e9s” s’ils acceptent d’\u00eatre sur la liste de l’\u00e9quipe sortante.<\/p>\n\n\n\n

Ces pratiques rejoignent les recrutements de colistiers sur les r\u00e9seaux sociaux que pratiquent certains \u00e0 la fa\u00e7on de pr\u00e9dateurs.<\/p>\n\n\n\n

Tout ceci ne peut aboutir qu’\u00e0 la constitution d’un conseil municipal de figurants, non motiv\u00e9, dont les int\u00e9r\u00eats sont contradictoires \u00e0 ceux de la commune.<\/p>\n\n\n\n

Avant le scrutin, je signalerai ces recrutements “int\u00e9ress\u00e9s” et, si vous me donnez votre confiance, une fois \u00e9lu, tous permis de construire, dossiers, et ventes de biens au profit d’un membre d’une liste candidate seront reconsid\u00e9r\u00e9s et\/ou annul\u00e9s devant la justice \u2696\ufe0f.<\/strong><\/p>\n\n\n\n
