A \u00e9couter \u00e9galement sur les radios RTML et RMC et \u00e0 voir sur T\u00e9lessonne<\/p>\n

Depuis 2 ans \u00e0 Linas, comme dans la plupart des communes de la grande couronne, nous constatons une recrudescence de constructions ill\u00e9gales ou d’implantation de caravanes sur des terrains non constructibles. Je ne peux accepter cela.<\/p>\n

Aussi, depuis deux ans, la commune engage syst\u00e9matiquement des actions en justice en se portant partie civile afin d’obtenir la d\u00e9molition de ces constructions. Cela est co\u00fbteux (27 proc\u00e9dures en cours), mais il en va du respect de la loi et surtout du respect de ceux qui ont construit leur maison en conformit\u00e9 avec les r\u00e8gles d’urbanisme. Le 16 d\u00e9cembre 2011, nous avons obtenu une d\u00e9cision de justice pronon\u00e7ant la d\u00e9molition de l\u2019une de ces constructions. Nous esp\u00e9rons qu\u2019il en sera de m\u00eame dans les autres proc\u00e9dures en cours. Par ailleurs, nous avons refus\u00e9 de r\u00e9gulariser les branchements ill\u00e9gaux sur les poteaux \u00e9lectriques.<\/p>\n

Les actions \u00e0 mettre en place :<\/h3>\n

Cependant, je ne peux me r\u00e9soudre \u00e0 attendre que les infractions soient commises et que les ann\u00e9es passent avant que justice soit rendue. C’est pourquoi, en plus des contentieux contre les b\u00e9n\u00e9ficiaires, nous allons aussi traquer les profiteurs de ce march\u00e9 parall\u00e8le :<\/p>\n

– la commune engagera syst\u00e9matiquement des poursuites contre les notaires qui auraient accept\u00e9 de dresser des actes douteux,<\/p>\n

– la commune fera saisir manu-militari le mat\u00e9riel de chantier des entreprises qui r\u00e9alisent les travaux. D\u00e9j\u00e0, nous avons l’accord du soutien des forces de l’ordre,<\/p>\n

– la commune va engager une d\u00e9nonciation aupr\u00e8s des services fiscaux des anciens propri\u00e9taires qui auraient vendu ou donn\u00e9 leurs terrains afin qu’un contr\u00f4le fiscal syst\u00e9matique soit op\u00e9r\u00e9,<\/p>\n

– enfin je regrette que nos d\u00e9put\u00e9s n’aient pas vot\u00e9 en 2006 l’amendement renfor\u00e7ant le droit de pr\u00e9emption qui permettrait aux communes de s’interposer \u00e0 tout projet de vente ou de donation d\u00e8s l’origine. Sur ce point, je vais saisir mes coll\u00e8gues Maires de l’Association des Maires Franciliens et avec leur accord nous engagerons une action collective afin de demander que cette disposition soit vot\u00e9e.<\/p>\n
