Cela se passe en France. Une v\u00e9ritable histoire de Clochemaires&#8230;<\/p>\n<\/div>\n<p>Le 14 janvier, Fr\u00e9d\u00e9ric Gilbert, journaliste t\u00e9l\u00e9 et r\u00e9alisateur, et Hind, Marocaine avec laquelle il a une fille de15 mois, se marieront \u00e0 Aubervilliers (Seine-Saint-Denis). Cette union sera d\u2019autant plus exceptionnelle que le service de l\u2019\u00e9tat-civil de la mairie l\u2019avait d\u2019abord refus\u00e9e, et qu\u2019ils ont d\u00fb attendre la d\u00e9cision du procureur de la R\u00e9publique, rendue le 30 d\u00e9cembre apr\u00e8s avoir \u00e9t\u00e9 saisi par Fr\u00e9d\u00e9ric, pour obtenir ce feu vert.<\/p>\n<p>En cause, un document administratif appel\u00e9 \u00ab certificat de coutume \u00bb, que les mairies demandent lorsque l\u2019un des futurs mari\u00e9s est de nationalit\u00e9 \u00e9trang\u00e8re. Pour cela, Fr\u00e9d\u00e9ric Gilbert se rend au consulat du Maroc, o\u00f9 il apprend que ce \u00ab certificat de coutume \u00bb ne peut lui \u00eatre donn\u00e9 s\u2019il ne signe pas un \u00ab acte de conversion \u00e0 l\u2019islam \u00bb.<\/p>\n<h4><\/h4>\n<h4>La conversion \u00e0 l&#8217;islam pour le mariage \u00e0 l&#8217;islam est-il obligatoire ?<\/h4>\n<p>Une obligation que lui confirme un agent de l\u2019\u00e9tat-civil : sans certificat de coutume, pas de mariage civil. \u00ab Je suis tomb\u00e9 des nues, avoue Fr\u00e9d\u00e9ric Gilbert. Je suis fils de cur\u00e9 d\u00e9froqu\u00e9, c\u2019est dire si je suis un la\u00efc convaincu, je ne veux pas me convertir \u00e0 l\u2019islam, m\u00eame pour la forme. Ma femme est musulmane, elle fait le ramadan, je respecte sa croyance, mais je resterai ath\u00e9. Et elle le comprend. \u00bb Le journaliste a fait son\u00a0<a href=\"http:\/\/actualites.leparisien.fr\/enquete.html\" target=\"_blank\" rel=\"nofollow\">enqu\u00eate<\/a>\u00a0dans d\u2019autres mairies et d\u00e9couvert que la pratique est r\u00e9pandue et que la plupart des futurs mari\u00e9s \u2014 4 677 mariages franco-marocains c\u00e9l\u00e9br\u00e9s en 2009 \u2014 pr\u00e9f\u00e8rent \u00ab se convertir pour de faux \u00bb, plut\u00f4t que de subir des complications administratives. \u00ab J\u2019ai aussi consult\u00e9 le Code civil, et il n\u2019est stipul\u00e9 nulle part que ce certificat est obligatoire, poursuit Fr\u00e9d\u00e9ric. Seul un certificat de c\u00e9libat de la personne \u00e9trang\u00e8re l\u2019est \u00bb.<\/p>\n<p>L\u2019affaire se serait arr\u00eat\u00e9e l\u00e0, si la m\u00e9diatisation de l\u2019affaire par \u00ab Charlie Hebdo \u00bb, dans un reportage intitul\u00e9 \u00ab Quand les maires se prennent pour des imams \u00bb, n\u2019avait pas suscit\u00e9 une avalanche de courriers accusateurs en mairie d\u2019Aubervilliers. Le maire\u00a0<a href=\"http:\/\/actualites.leparisien.fr\/ps.html\" target=\"_blank\" rel=\"nofollow\">PS<\/a>\u00a0avoue \u00ab \u00eatre tomb\u00e9 de l\u2019armoire \u00bb. \u00ab J\u2019ai pris l\u2019affaire tr\u00e8s au s\u00e9rieux, et demand\u00e9 une note juridique aux services, avoue Jacques Salvator. Je n\u2019avais jamais entendu parler de cet acte de conversion, et encore moins qu\u2019on refusait de marier en son absence. Ce que ce monsieur d\u00e9nonce est vrai. \u00bb Soutenant la d\u00e9marche de son administr\u00e9, le maire sera d\u2019ailleurs pr\u00e9sent au mariage, au c\u00f4t\u00e9 d\u2019Edgar Minimbu, adjoint \u00e0 l\u2019\u00e9tat-civil, qui a jou\u00e9 les m\u00e9diateurs avec le couple.
