Enfin, j’ai obtenu ce que je voulais. Cela n’a pas \u00e9t\u00e9 facile mais \u00e7a valait le coup.<\/p>\n

Depuis des mois, je demande \u00e0 pouvoir consulter le compte de campagne de mon adversaire. C’est la moindre des choses puisqu’il pr\u00e9tend que si la Commission Nationale des Comptes de Campagne lui a valid\u00e9 ses d\u00e9penses et rembours\u00e9 sa campagne, c’est que tout est nickel.<\/p>\n

Si c’est lui qui le dit…c’est que \u00e7a doit \u00eatre faux !!<\/p>\n

Je pr\u00e9cise quand m\u00eame que j’ai demand\u00e9 d\u00e8s le mois de juillet \u00e0 consulter ce compte (DDe CNCCFP 11 juillet 2011.pdf), que comme je n’ai pas obtenu de r\u00e9ponse, il aura fallu que je saisisse la CADA (Saisine CADA.pdf) pour qu’elle me donne raison et ordonne que je puisse voir ce document si secret.<\/p>\n

Quand on pense que le compte de campagne est le document officiel que produit un candidat pour justifier la r\u00e9gularit\u00e9 de ses d\u00e9penses de campagne et se faire rembourser par l’Etat, ce document devrait \u00eatre public. Comme quoi, il y a encore du boulot pour ceux qui veulent am\u00e9liorer notre d\u00e9mocratie.<\/p>\n

J’ai donc, sur rendez-vous, consult\u00e9 et pris une copie du compte de campagne de mon adversaire. Et ce que je suspectais s’est confirm\u00e9. Plusieurs tracts de propagande, autres que “Le Petit Linois N\u00b01”, ne sont pas \u00e9voqu\u00e9s dans le compte. C’est le cas par exemple pour le tract de soutien de Mme Antonetti pour le second tour. Il est \u00e0 noter que ce tract a \u00e9t\u00e9 imprim\u00e9 sur un photocopieur couleur “inconnu au bataillon”, ainsi que le tract de Monsieur Frontera qui, au second tour, avait \u00e9galement appel\u00e9 \u00e0 voter pour lui.<\/p>\n

J’ai eu du flair puisque j’avais exactement mentionn\u00e9 ces irr\u00e9gularit\u00e9s probables dans mon recours.<\/p>\n

Quelle est la cons\u00e9quence : C’est tr\u00e8s simple, lorsque le Tribunal a annul\u00e9 l’\u00e9lection pour cause d’affichage ill\u00e9gal et financement d’un journal de propagande par l’association MVL, il a aussi mentionn\u00e9 la formule “consid\u00e9rant que d\u00e8s lors, et sans qu’il soit besoin d’examiner les autres griefs de la protestation, le protestataire (c’est a dire moi) est fond\u00e9 \u00e0 demander l’annulation des op\u00e9rations \u00e9lectorales qui se sont d\u00e9roul\u00e9es dans le canton de Montlh\u00e9ry les 20 et 27 mars 2011”.<\/p>\n

Cela signifie que les juges n’ont pas perdu de temps \u00e0 \u00e9tudier le compte de campagne de M. Cau\u00ebt (cela faisait partie des autres griefs) puisqu’ils avaient trouv\u00e9 suffisamment de raisons d’annuler l’\u00e9lection mais s’ils l’avaient fait, il y a de grandes probabilit\u00e9s qu’ils auraient trouv\u00e9 de nouvelles irr\u00e9gularit\u00e9s justifiant, elles aussi, l’annulation.<\/p>\n
