A pr\u00e9sent que le corps est refroidi et que les obs\u00e8ques de Jean Germain se sont achev\u00e9es en ce lundi 13 avril, aurions-nous cinq minutes pour r\u00e9fl\u00e9chir \u00e0 ce drame que nous aurions pu \u00e9viter?<\/p>\n

Je dis “nous”, car lorsque la mort d’un homme<\/a> est cons\u00e9cutive \u00e0 l’action des institutions de la R\u00e9publique, c’est nous tous qui devons-nous sentir responsables. La justice n’agit-elle pas au nom des Fran\u00e7ais?<\/p>\n

Contrairement au suicide de Pierre B\u00e9r\u00e9govoy en 1993, le d\u00e9bat est bien pauvre apr\u00e8s celui de Jean Germain. O\u00f9 est donc pass\u00e9 notre esprit critique? Il y a trois mois, la France se soulevait pour raviver l’h\u00e9ritage des Lumi\u00e8res, mais c’est maintenant qu’il faudrait s’en servir. Soyons Charlie<\/a> jusqu’au bout.<\/p>\n

Ce ne sont pas les \u00e9tincelles qui manquent pour mettre le feu aux poudres, mais pour l’instant nous n’avons vu, au carnaval m\u00e9diatique, que des p\u00e9tards mouill\u00e9s: le pr\u00e9sident du S\u00e9nat, second personnage de l’Etat a d\u00e9nonc\u00e9<\/a>: “Ce syst\u00e8me qui s’emballe sans discernement, sans consid\u00e9ration pour l’honneur, peut amener un homme \u00e0 commettre l’irr\u00e9parable”. Personne ne s’interroge sur le fait de savoir qui est “ce syst\u00e8me” ainsi d\u00e9sign\u00e9. En 1993, Fran\u00e7ois Mitterrand avait \u00e9t\u00e9 invit\u00e9, dans une interview, \u00e0 expliquer qui \u00e9tait le “on” de la phrase “on ait pu livrer aux chiens…”<\/a> et qui \u00e9taient “les chiens”? Il n’avait pas voulu r\u00e9pondre.<\/p>\n

Pourquoi les m\u00eames secrets<\/a> les m\u00eames “non-dits” 22 ans plus tard?<\/p>\n

Celui qui semble le plus audacieux serait l’avocat Dominique Trincaud qui pointe un “procureur politiquement engag\u00e9” et une connexion entre la politique et la justice.<\/p>\n

La France a connu depuis 30 ans une judiciarisation croissante de la vie politique. Depuis les enqu\u00eates d’Eva Joly, publi\u00e9es quotidiennement dans le Monde, notre pays n’a eu de cesse que de chasser les moindres turpitudes de ses \u00e9lus et de faire connaitre \u00e0 tous les moindres soup\u00e7ons qui p\u00e8sent sur eux.<\/p>\n

Cette pratique trouve certainement sa place dans d’autres cultures plus scandinaves, plus anglo-saxonnes, ou dans d’autres pays o\u00f9 l’on peut, sans \u00e9moi, exhiber un pr\u00e9sident du FMI menott\u00e9 devant les cam\u00e9ras. Mais en France cette politique est un triple \u00e9chec.<\/p>\n

On a cru lutter contre la corruption de quelques-uns en accentuant les mises en cause de tous. Cela est aussi absurde que d’opprimer une communaut\u00e9 pour expier les m\u00e9faits de ses membres les plus insaisissables. En cherchant les moindres incartades des \u00e9lus et au besoin dans leurs activit\u00e9s extra-politiques, on a banalis\u00e9 les actes les plus graves. Allez prendre une bi\u00e8re \u00e0 Levallois-Perret et vous entendrez le peuple rire de d\u00e9rision au sujet des ennuis judiciaires du d\u00e9put\u00e9-maire<\/a>.<\/p>\n

On a cru donner l’image d’une justice int\u00e8gre et \u00e9gale pour tous, mais les fuites, les emballements pour des affaires qui finalement n’en \u00e9taient pas, l’ont discr\u00e9dit\u00e9e. Combien de non-lieux, combien de relaxes ont aliment\u00e9 le sentiment d’une justice indulgente avec les \u00e9lus et dure avec les autres?<\/p>\n

On a cru assainir la politique, mais la politique s’est adapt\u00e9e en instrumentalisant bien souvent cette nouvelle pratique justici\u00e8re. Pour s’en convaincre, il suffit de comparer les proc\u00e8s-verbaux des conseils municipaux et autres assembl\u00e9es d’\u00e9lus \u00e0 30 ans d’intervalle. Les d\u00e9bats d’id\u00e9es ont disparu et ont laiss\u00e9 place aux proc\u00e8s de toutes sortes. Pour battre un homme politique aujourd’hui on ne le conteste plus, on lui cherche des casseroles. Cela, je le vois dans ma propre commune o\u00f9 mon opposition est bien plus active aupr\u00e8s des tribunaux que dans les d\u00e9bats au Conseil municipal (0 minute et 0 seconde pour le d\u00e9bat budg\u00e9taire 2015). Il y a peu, j’avais dans mes adversaires politiques, un fonctionnaire de l’inspection du travail. Eh bien, curieusement, j’ai subi 3 contr\u00f4les dans mes activit\u00e9s, pourtant extra-municipales, dont certains engag\u00e9s contre toute coh\u00e9rence, et d’autres relay\u00e9s par la justice.<\/p>\n

Le r\u00e9sultat de tout cela est un \u00e9norme g\u00e2chis. A un moment o\u00f9 de moins en moins de nos concitoyens se sentent citoyens. \u00c0 un moment o\u00f9 les associations manquent de b\u00e9n\u00e9voles et les collectivit\u00e9s locales d’\u00e9lus, on d\u00e9signe, on humilie, on garde \u00e0 vue, on d\u00e9truit tout ce qu’un \u00e9lu a de plus sacr\u00e9: son honneur.<\/p>\n

Jean Germain, comme tant d’autres \u00e9lus locaux, avait ce code d’honneur, c’est d’ailleurs ce qui diff\u00e9rencie les R\u00e9publicains des chiens.<\/p>\n

Dans les m\u00e9dias, comme devant la justice, l’honneur, l’honorabilit\u00e9 ne vaut rien. C’est ainsi qu’un maire, certainement pas un ange, mais r\u00e9\u00e9lu de multiples fois \u00e0 la t\u00eate d’une des plus belles et plus grandes villes de France peut rendre son dernier souffle dans un garage au bout de son fusil de chasse<\/a> sans que cela n’entra\u00eene la moindre enqu\u00eate pr\u00e9liminaire, le moindre sentiment de culpabilit\u00e9. A l’\u00e9poque o\u00f9 le plus petit homicide est suivi d’un d\u00e9ploiement de moyens scientifiques impressionnant, la mort de Jean Germain, elle, s’expliquerait par des analyses rapides de comptoir, fragilit\u00e9 psychologique, d\u00e9prime, d\u00e9faite… Que sais-je ?<\/p>\n

On s’interroge souvent pour conna\u00eetre le moteur des \u00e9lus. Savoir ce qui les pousse \u00e0 conqu\u00e9rir et garder le pouvoir. On imagine toutes sortes de choses mais l’honneur est tr\u00e8s certainement le d\u00e9nominateur commun.<\/p>\n

L’honneur est \u00e0 l’\u0153uvre \u00e0 chaque fois que la R\u00e9publique a besoin de ses fils et rien ne peut mieux expliquer que des femmes et des hommes se d\u00e9vouent pour l’int\u00e9r\u00eat g\u00e9n\u00e9ral dans une soci\u00e9t\u00e9 individualiste o\u00f9 il serait si facile de ne penser qu’\u00e0 soi.<\/p>\n

Est-il si difficile de comprendre cela? C’est en tout cas l’enseignement que Jean Germain a consid\u00e9r\u00e9 plus important que sa vie:<\/p>\n

“Je sais le mal que je vais faire, la peine que je vais diffuser \u00e0 ceux qui m’aiment. Mais on ne peut laisser la chasse syst\u00e9matique aux politiques se d\u00e9rouler “normalement”, quotidiennement. Il est des \u00eatres, j’en suis s\u00fbr, pour lesquels l’injustice et le d\u00e9shonneur sont insupportables. Soyez s\u00fbrs que je n’ai jamais d\u00e9tourn\u00e9 un centime, que je ne me suis pas enrichi, que j’ai toujours \u0153uvr\u00e9 pour ce que je pensais \u00eatre le bonheur des Tourangeaux. Je laisse ce courrier \u00e0 mes proches qui, je l’esp\u00e8re, pourront comme \u00e7a comprendre.”<\/p>\n","protected":false},"excerpt":{"rendered":"
